DURHAM - Durham police are now saying that a man who they previously announced was a murder victim was actually killed when he was hurled from his car in a traffic accident into a tree.

Police say that they are now investigating the death of an unnamed man as a traffic accident which was first reported early Monday on Chapel Hill Road.

Durham police officers were dispatched at 12:10am to a traffic accident with injuries in the parking lot of Chesterfield Apartments at 1808 Chapel Hill Road. When they arrived, they found a man in his 20's lying next to a vehicle and he was pronounced dead at the scene, say police.

Police say that they initially thought it could be a homicide as an investigation revealed that the man had been in an altercation on House Avenue and suffered head injuries at that location.

However, police say that numerous interviews with witnesses, a re-examination of the scene and the results of an autopsy indicated that the victim, whose name has been released at this time, actually died as a result of a traffic accident following the altercation.

Police say that they learned that after the fight the man got in the back of a car driven by a female acquaintance.

The driver hit a ditch culvert on Morehead Avenue near Rex Street and then hit a tree. The accident occurred a short distance from House Avenue and the deceased man was not wearing a seat belt, say police.

The woman then drove to the 1800 block of Chapel Hill Road and police were called to the scene.

According to the Durham Police, the case has now been referred to the Police Department's Traffic Services Unit. ::
